Terms of Service
Policy Penguin provides insurance policy analysis and education tools (“Service”). These Terms of Service (“Terms”) govern your use of the Service, including all features such as policy analysis, chat, insights, and any interactive tools. By using Policy Penguin, you agree to these Terms.
1. Use of Service
Policy Penguin analyzes insurance policy information you provide or authorize us to access and delivers structured analysis, including coverage summaries, discount opportunities, coverage gap identification, and rate benchmarking. The Service is available in both free and paid tiers. You may use the Service only for lawful purposes and in accordance with these Terms.
2. Not Insurance Advice
This is important. Policy Penguin provides insurance education and policy analysis. This applies to all features of the Service, including chat conversations, generated insights, and any interactive tools. We are not an insurance broker, agent, or adjuster. We do not sell insurance and we do not earn commissions from carriers.
All output from the Service is informational only:
- We explain what your policy documents say. We do not tell you what coverage to buy.
- We identify potential gaps and opportunities. We do not make personalized recommendations.
- We provide market context and benchmarks. We do not guarantee savings or outcomes.
- Chat responses and interactive features are subject to the same limitations as any other analysis.
For coverage determinations, claim decisions, or personalized insurance advice, consult your carrier or a licensed insurance professional. Our analysis is a starting point for informed conversations, not a substitute for professional guidance.
3. Your Policy Documents Govern
Our analysis is derived from the information you provide. Your original policy documents, as issued by your carrier, are the authoritative source for your coverage. In any case where our analysis differs from your actual policy, your policy governs.
We extract and display factual information (such as carrier names, premium amounts, and coverage details) from user-provided documents for the purpose of analysis on the user’s behalf. Third-party names and trademarks are used for identification purposes only and do not imply endorsement or affiliation.
4. Data Sources and Processing
You may provide information to us in several ways, including uploading documents, entering data manually, forwarding communications, or authorizing us to access information on your behalf. Regardless of how information reaches us:
- You retain full ownership of your data.
- Original documents are processed and deleted promptly. We do not store original documents.
- We store the structured data extracted from your information in your private vault.

5. Your Responsibilities
You are responsible for:
- Providing accurate account information.
- Maintaining the security of your login credentials.
- Only providing documents and information you are authorized to share (your own policies or those you have permission to analyze).
- Providing valid authorization for any accounts or services you connect to Policy Penguin.
- Complying with all applicable laws in your use of the Service.
- Verifying analysis against your original policy documents before acting on it.
6. Fees and Billing
Some features of the Service require a paid subscription. If you subscribe to a paid plan, you agree to pay the fees specified at the time of purchase. You may cancel at any time. Billing terms, including renewal and refund policies, are presented at the time of purchase.
7. AI-Generated Content
Our analysis is powered by artificial intelligence. While we work to provide accurate and useful results:
- AI analysis may not capture every detail in your documents.
- Accuracy depends on document quality, format, and the information provided.
- Results reflect general insurance knowledge and may not account for your specific circumstances, state regulations, or carrier-specific rules.
You should always verify important findings against your original policy documents.
8. Aggregate Data
We may use anonymized, aggregate data derived from our user base to improve the Service, generate market benchmarks, and provide better analysis for all users. This aggregate data never identifies individual users or their specific policies. See our Privacy Policy for details.
9. API and Developer Access
If you access the Service through our API or developer tools, these Terms apply to that use as well. API access may be subject to additional usage limits and guidelines provided at the time of access. You may not use the API to build a competing service.
10. Intellectual Property
Policy Penguin’s technology, including our patent-pending analysis methods, is our intellectual property. Your use of the Service does not grant you any rights to our technology, trademarks, or proprietary methods.
Your data remains your property. We claim no ownership over your documents or the structured data extracted from them.
11. Service Availability
We strive to provide reliable access, but we do not guarantee uninterrupted or error-free operation. We may update, modify, or temporarily suspend parts of the Service at any time.
12. Disclaimer and Limitation of Liability
The Service is provided for informational and educational purposes only. We make no warranties, express or implied, about the accuracy, completeness, or fitness of our analysis for any particular purpose.
We are not responsible for decisions you make based on our analysis, including decisions made based on chat responses, generated insights, or any other output of the Service. Insurance decisions should involve consultation with licensed professionals who can evaluate your specific situation.
To the fullest extent permitted by law, our total liability is limited to the fees you paid to us in the 12 months before the claim.
13. Indemnification
You agree to hold Policy Penguin harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your misuse of the Service, (b) providing documents or information you are not authorized to share, (c) inaccurate data you provide manually, or (d) your violation of these Terms. This does not limit any rights you may have under applicable consumer protection laws.
14. Dispute Resolution
Informal resolution first. Before filing any formal claim, you agree to contact us at the email below and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration. If we cannot resolve a dispute informally, either party may elect to resolve it through binding arbitration administered under the rules of the American Arbitration Association. Arbitration will take place in the State of Georgia or remotely at your election. The arbitrator’s decision is final and enforceable in any court.
Class action waiver. You and Policy Penguin agree to resolve disputes only on an individual basis. Neither party may participate in a class action, class arbitration, or other representative proceeding.
Small claims exception. Either party may bring qualifying claims in small claims court.
15. Termination
You may delete your account at any time. Upon deletion, your data is deleted per our Privacy Policy.
We may suspend or terminate your access if you violate these Terms or misuse the Service.
16. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use after changes take effect constitutes acceptance.
